Terms of Use
1. Purpose
The purpose of these Terms of Use is to define the conditions of access to and use of the site www.benoistrousseau.com.
Accessing and using the site implies full, complete, and unreserved acceptance of these Terms of Use by any user.
The site is published by BENOIST ROUSSEAU SLU, a company incorporated under Andorran law, in compliance with the regulations applicable in the Principality of Andorra, in particular Law 20/2014 of 16 October regulating electronic contracting and operators carrying out their economic activity in the digital space. 2. Access to the site
The site is freely accessible to any user with internet access.
Certain services or areas of the site, in particular the member area, the blog, the forum, the newsletter, or certain reserved content, may require prior registration, a username, or a password.
The publisher endeavors to ensure normal access to the site 24/7, without being bound by any obligation of result regarding availability.
The publisher may suspend, limit, or interrupt access to all or part of the site at any time, in particular for maintenance, updates, technical requirements, security, or force majeure, without this giving rise to any right to compensation.
3. USER ACCOUNT
Creation and responsibility
Where the creation of an account is necessary, the user undertakes to provide accurate, complete, and up-to-date information.
The user is solely responsible for the confidentiality of their credentials and passwords, as well as for the use made of them.
Any connection or action carried out from a user account is presumed to be made by its holder.
The user undertakes to immediately inform BENOIST ROUSSEAU SLU of any unauthorized use of their account or any breach of the confidentiality of their credentials.
Types of accounts
The site offers a forum / community account, subject to the following rules:
Forum / community account
The forum account allows the user to take part in discussions, post comments, and interact with the community.
In the event of prolonged inactivity on the forum for a period of three (3) years, the publisher may delete the account concerned, as well as the associated data that is not necessary for legal retention or the proper administration of the site.
Before any deletion, the user will be informed by email at the address associated with their account, with 30 days' notice allowing them to reconnect to keep their account active.
Voluntary deletion
The user may at any time request the deletion of their account by sending a request to benoist@benoistrousseau.com.
4. Authorized use of the site
The user undertakes to use the site in accordance with the law, public morality, public order, these Terms of Use, and the rights of third parties.
The following are prohibited in particular:
- any fraudulent, abusive, or unlawful use of the site;
- any attempt at unauthorized access to a system, account, data, or feature;
- any disruption or attempt to disrupt the proper functioning of the site;
- any use of the site for purposes of spam, phishing, harassment, distribution of viruses, or malicious content;
- any substantial reproduction, extraction, copying, distribution, or reuse of the site's content without prior written authorization.
The publisher reserves the right to suspend or delete, without notice, the access of any user who does not comply with these Terms of Use.
5. Comments, blog, and forum
Where the site allows the publication of comments, messages, or contributions, the user remains solely responsible for the content they publish.
It is prohibited to publish content that is:
- contrary to the law;
- defamatory, insulting, hateful, threatening, or obscene;
- infringing the rights of others;
- advertising, promotional, or akin to spam;
- harmful to the security, integrity, or proper functioning of the site.

6. Newsletter
Subscription to the newsletter is voluntary.
Registration for the newsletter is subject to a double opt-in procedure, consisting of sending a confirmation email containing a unique link allowing the subscription request to be definitively validated.
In the absence of confirmation, the email address and the technical data associated with the request are deleted within the period stated on the site.
The user may unsubscribe at any time via the unsubscribe link included in each mailing.

7. Personal data
The processing of personal data collected via the site is governed by the Privacy Policy.
BENOIST ROUSSEAU SLU acts as data controller for the data collected directly via the site, in compliance with the applicable Andorran law on personal data protection. 8. Cookies
The site may use cookies strictly necessary for its operation, for session management, for connecting to the user account, for remembering certain preferences, and for improving the user experience.
When the user posts a comment, certain cookies may be offered in order to record, for their convenience, their entered information.

10. Intellectual property

Commitment
BENOIST ROUSSEAU SLU is committed to making the site www.benoistrousseau.com accessible to as many people as possible, in accordance with the principles of digital accessibility.
Although the company currently benefits from the exemption provided for micro-enterprises within the meaning of Directive (EU) 2019/882 (European Accessibility Act), BENOIST ROUSSEAU SLU voluntarily places its approach within a logic of continuous improvement of the accessibility of its digital content and services.
