1. Purpose
The purpose of these Terms of Use is to define the terms of access and use of the site www.benoistrousseau.com.
Access to the site and its use imply the full, complete, and unconditional acceptance of these Terms of Use by any user.
The site is published by BENOIST ROUSSEAU SLU, a company incorporated under Andorran law, in compliance with the regulations applicable in the Principat d'Andorra, in particular the Llei 20/2014, del 16 d'octubre, reguladora de la contractació electrònica i dels operadors que desenvolupen la seva activitat econòmica en un espai digital (Andorran law governing electronic contracts and operators conducting their economic activity in a digital space). 2. Access to the site
The site is accessible free of charge to any user with Internet access.
Certain services or areas of the site, in particular the member area, the blog, the forum, the newsletter, or certain restricted content, may require prior registration, a username, a password.
The publisher endeavors to ensure normal access to the site 24 hours a day, 7 days a week, without being bound by any obligation of result regarding availability.
The publisher may suspend, limit, or interrupt access to all or part of the site at any time, in particular for maintenance, updates, technical requirements, security, or force majeure, without this giving rise to any right to compensation.
3. User account
Creation and liability
When the creation of an account is necessary, the user undertakes to provide accurate, complete, and up-to-date information.
The user is solely responsible for the confidentiality of their login credentials and passwords, as well as for the use made of them.
Any connection or action carried out from a user account is presumed to be performed by its holder.
The user undertakes to immediately inform BENOIST ROUSSEAU SLU of any unauthorized use of their account or any breach of the confidentiality of their login credentials.
Account types
Forum / community account
The forum account allows the user to participate in discussions, publish comments, and interact with the community.
In the event of prolonged inactivity on the forum for a period of three (3) years, the publisher may delete the account concerned, as well as the associated data not necessary for legal retention or the proper administration of the site.
Prior to any deletion, the user will be informed by email at the address associated with their account, with a 30-day notice period allowing them to log in to keep their account active.
Voluntary deletion
The user may request the deletion of their account at any time by sending a request to benoist@benoistrousseau.com.
4. Authorized use of the site
The user undertakes to use the site in accordance with the law, good morals, public order, these Terms of Use, and the rights of third parties.
In particular, the following are prohibited:
- any fraudulent, abusive, or unlawful use of the site;
- any attempt to gain unauthorized access to a system, account, data, or functionality;
- any disruption or attempted disruption of the proper functioning of the site;
- any use of the site for the purposes of spam, phishing, harassment, or the distribution of viruses or malicious content;
- any reproduction, extraction, copying, distribution, or substantial reuse of the site's content without prior written authorization.
The publisher reserves the right to suspend or delete, without notice, the access of any user who does not comply with these Terms of Use.
5. Comments, blog, and forum
When the site allows the publication of comments, messages, or contributions, the user remains solely responsible for the content they publish.
It is prohibited to publish content that is:
- contrary to the law;
- defamatory, insulting, hateful, threatening, or obscene;
- infringing upon the rights of others;
- advertising, promotional, or akin to spam;
- compromising the security, integrity, or proper functioning of the site.
The publisher reserves the right, at its sole discretion, to moderate, refuse, move, hide, or delete any content published on the blog or the forum, without prior justification and without this giving rise to any right to compensation.
The publisher also reserves the right to suspend or delete the account of a user whose behavior would harm the proper functioning of the site, the forum, or the community.
6. Newsletter
Subscription to the newsletter is on a voluntary basis.
Registration for the newsletter is subject to a double opt-in procedure, consisting of sending a confirmation email containing a unique link to definitively validate the subscription request.
In the absence of confirmation, the email address and the technical data associated with the request are deleted within the timeframe announced on the site.
The user may unsubscribe at any time via the unsubscribe link included in each mailing.
The rules applicable to the collection, retention, and deletion of data relating to the newsletter are detailed in the Privacy Policy, in accordance with the Llei 29/2021, del 28 d'octubre, qualificada de protecció de dades personals (Andorran qualified law on personal data protection, LQPD). 7. Personal data
The processing of personal data collected via the site is governed by the Privacy Policy.
BENOIST ROUSSEAU SLU acts as the data controller for the data collected directly via the site, in compliance with the applicable Andorran law regarding personal data protection. The Llei 29/2021 protects the personal data of all natural persons, regardless of their nationality or residence. (Llei 29/2021 on the Portal jurídic del Principat d'Andorra)
The user may exercise their rights of access, rectification, deletion, opposition, limitation, and portability at the following address: benoist@benoistrousseau.com. The Andorran application regulation of the Llei 29/2021 also specifies the duty of information and certain practical modalities of application. 8. Cookies
The site may use cookies strictly necessary for its operation, session management, user account login, memorization of certain preferences, and improvement of the user experience.
When the user leaves a comment, certain cookies may be offered in order to save, for their convenience, their input information.
When the user logs into their account, technical session and preference cookies may be used.

9. Embedded content and third-party services
The site may embed content and functionalities from third-party services. This content behaves as if the user were visiting the third-party site directly. These services may collect data, set cookies, and track the user's interactions, particularly if the user already has a logged-in account with the service concerned.

BENOIST ROUSSEAU SLU cannot be held liable for the operation, policies, or processing implemented by these third-party services, which remain solely responsible for their own tools and processing.
The user is invited to consult the privacy policies of each third-party service to learn about the terms of collection and processing of their data; links to these policies can be found in section 9 of the Privacy Policy of BENOIST ROUSSEAU SLU.

No personal data is sold, rented, or transferred for commercial purposes to third parties.

10. Intellectual property
All elements present on the site, in particular texts, articles, images, videos, logos, databases, graphic design, structure, domain name, and more generally any content published on www.benoistrousseau.com, are protected by intellectual property law and remain the exclusive property of BENOIST ROUSSEAU SLU, unless otherwise stated.
Unless prior written authorization is obtained, any reproduction, representation, adaptation, republication, translation, extraction, distribution, or exploitation, in whole or in part, of the site's content, by any process whatsoever, is prohibited.
The publisher only authorizes, unless expressly agreed otherwise, the reuse of an article's title accompanied by a direct link to the article concerned or to the main page of the site, excluding the reproduction of the text itself.
Any unauthorized use constitutes an infringement of intellectual property rights liable to incur the civil and/or criminal liability of its author.
11. Hypertext links
The site may contain links to external sites.
These links are provided for informational purposes. BENOIST ROUSSEAU SLU exercises no control over the content of these sites and disclaims all liability regarding their content, availability, legality, privacy policies, or practices.
The creation of links to the site is authorized provided that it does not harm the image, rights, or legitimate interests of BENOIST ROUSSEAU SLU.
12. Liability

14. Modification of the Terms of Use
BENOIST ROUSSEAU SLU reserves the right to modify these Terms of Use at any time.
The applicable version is the one in force on the date of browsing or use of the site by the user.
Any substantial modification will be notified to registered users by email with a reasonable notice period.
15. Applicable law and competent jurisdiction
These Terms of Use are governed by Andorran law.
Any dispute relating to the interpretation, validity, or execution of these Terms of Use falls within the jurisdiction of the Andorran courts, subject to any mandatory rules that may be applicable for the benefit of users according to their country of residence.
Language of the contract. These Terms of Use are drawn up in Catalan, the official language of the Principality of Andorra, and the Catalan version is authoritative. The French version and other translations are provided for the user's convenience. In the event of a discrepancy between the Catalan version and any of its translations, the Catalan version shall prevail. This clause cannot deprive the user of the protection afforded to them by the mandatory provisions of the law of their country of residence.
16. Accessibility statement
Commitment
BENOIST ROUSSEAU SLU is committed to making the site www.benoistrousseau.com accessible to the greatest number of people, in accordance with the principles of digital accessibility.
Although the company currently benefits from the exemption provided for micro-enterprises within the meaning of Directive (EU) 2019/882 (European Accessibility Act), BENOIST ROUSSEAU SLU voluntarily pursues an approach of continuous improvement of the accessibility of its digital content and services.
Targeted standard
The site endeavors to comply with the recommendations of the Web Content Accessibility Guidelines (WCAG) 2.2, level AA, published by the World Wide Web Consortium (W3C).
